Mr. Roshan Kumar, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 20-03-2024 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.

2. The petitioner seeks bail in connection with Kotwali P.S. case No. 588 of 2022 instituted for the offences under Sections 467, 468, 471, 406, 420, 504, 506 of the Indian Penal Code.

3. Prosecution case, in short, is that this petitioner has embezzled a sum of Rs. 81,774/- from the informant.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case.

No.21062 of 2024(2) dt.20-03-2024 2/3 Learned counsel for the petitioner submitted that, admittedly, it is a dispute of civil nature which has been converted into criminal proceeding with ulterior motive. Learned counsel further submitted that petitioner is ready to return Rs. 25,000/- to the informant. Learned counsel further submitted that petitioner is also ready to deposit the rest amount of money in concerned District Court Nazarat, subject to the outcome of the trial. It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.12.2023 and has three criminal antecedents.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Kotwali P.S. case No. 588 of 2022, subject to the following conditions :- (I) Petitioner shall pay a sum of Rs. 25,000/- in the

(II) Petitioner shall deposit a sum of Rs. 56,774/- in the Nazarat of the concerned District Court, which will be subject to the outcome of trial.

If any of the above conditions are not fulfilled, the informant will have liberty to file an application for cancellation of bail granted to the petitioner.
