Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 25(1B)a/26/35 of the Arms Act. As per the prosecution case, on secret information police conducted raid and arrested thee criminals including this petitioner and on search one mobile phone was recovered from the physical possession of the petitioner and arms manufacturing articles were also recovered from the hut of this petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Hut from where recovery has been made is situated on the bank of a pond which is a public place and it does not belong to this petitioner. No incriminating material has been recovered from the conscious possession of the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in Madhepura Police Station Case No. 915 of 2020.
