The petitioners seek bail in a case registered under Sections 341, 323, 504, 506, 427, 384/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons assaulted the informant and his father by means of fists and slaps and they fired upon the informant and his father, which did not hit to anybody.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 15.01.2019. Charge sheet has

Patna High Court CR. MISC. No.16487 of 2019(2) dt.12-04-2019 2/2 been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioners. Petitioners have falsely been implicated in the present case. The alleged occurrence is said to have taken place due to petty reason. General and omnibus allegation has been made. None is said to have been injured in course of occurrence.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahampur (Nainizore O.P.) P.S. case No.577 of 2018.
