Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 387, 379, 427, 147, 506 of the Indian Penal Code.

No.27391 of 2021(2) dt.01-02-2022 2/3 The prosecution case as per F.I.R is that the petitioner along with eight to ten accused persons came at the shop of the informant and demanded Rs. 1,00,000/- as ransom and when the informant protested, he took away cash of Rs. 25,000/- from the pocket of the informant and wrist watch. The accused persons also destroyed the shop of the informant and threatened of dire consequences, if ransom amount is not paid.

It is submitted by learned counsel for the petitioner that in the background of some land dispute the present accusation has been levelled against the petitioner. It is further submitted that much prior to filing of the present F.I.R, the uncle of the petitioner has filed a Sanha against the uncle of the informant alleging that his land has forcibly been captured by him. Moreover, the petitioner was not apprehended from the spot and nothing has been recovered from the conscious possession of the petitioner.

No.27391 of 2021(2) dt.01-02-2022 3/3 In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VIII, Patna in connection with Gopalpur P.S. Case No. 199 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
