The appellant seeks pre-arrest bail in connection with Kasba P.S. Case No.67 of 2020 registered under Sections 341, 354(B), 379, 504/34 of the Indian Penal Code and Sections 3(i) (r)(s), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Submission of learned counsel for the appellant is that the appellant is innocent and has falsely been implicated in the present case. Further submission is that co-accused Ranveer Kumar @ Chhotu Kumar and Akhilesh Kumar @ Appu Mahto have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 12.04.2021 passed in Cr.Appeal (SJ) No.414 of 2021. The case of the appellant stands

Patna High Court CR. APP (SJ) No.2191 of 2021(2) dt.28-10-2021 2/2 on the same footing. The appellant has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named appellant be released on bail, in the event of arrest or surrender, on furnishing personal bond to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, Purnea in connection with Kasba P.S. Case No.67 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Accordingly, the appeal is allowed and the impugned order dated 23.01.2021 passed in A.B.P. No.48 of 2020 (CIS48/20 is set aside. (Arvind Srivastava, J) Harish/- U T
