JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 The petitioner is apprehending his arrest in connection with Shikarpur P.S. Case No. 418 of 2014 for the offences instituted under Sections 341, 323, 324, 326, 307, 379, 506, 509 and 120(B)/34 of the IPC.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that while the informant was returning from the village, five persons came out from the cane field and intercepted him and started assaulting with Danda and tried to kill him. One of them inflicted knife in his hand and abdomen and caused injury and also opened fire. They also took out Rs. 5100/- and motorcycle of the informant.

Patna High Court Cr.Misc. No.29203 of 2015 (2) dt.27-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is not named in the F.I.R., nor he has been put on T.I.P. to ascertain the involvement of the petitioner in the alleged crime. The only material against the petitioner is that his name has transpired merely on the basis of suspicion.

On behalf of the State it has been submitted that the petitioner's name appeared in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Shikarpur P.S. Case No. 418 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
