JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147 , 148, 149, 341, 323, 337, 324, 307, 504 and 379 of the Indian Penal Code.
The allegation against the petitioners and other is that they abused and assaulted the informant with fists, slaps, brick and bats and accused Mantu Gope opened 4-5 rounds firing from country made pistol but did not hit him as he got concealed himself in wheat field.
It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. There is no specific allegation against the petitioners. There is no
Patna High Court Cr.Misc. No.28076 of 2015 (3) dt.29-09-2015 injury caused by firing. From perusal of the case diary, it appears that the injuries sustained are simple in nature. The matter has been compromised between the parties.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Saran, Chapra in connection with Sonepur P.S.Case No.72 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
