The present writ petition has been filed for issuance of appropriate direction to the Circle Officer, Bikramganj, Rohtas (respondent No.4) to dispose of the petition dated 26.09.2022 supported by an affidavit filed on behalf of the petitioner as contained in Annexure-3 with regard to take decision relating to the rent of the land appertaining to R.S. Khata No. 630, Plot No. 891 measuring an area of 92 Decimal situated at Mauza- Dharupur, P.S.- Bikramganj, District- Rohtas.

3. Counsel for the State raised preliminary objection and submits that from the order passed in B.L.T. Case No. 38 of

Patna High Court CWJC No.5073 of 2023(3) dt.31-08-2023 2/2 2022, the matter was remanded back to the Circle Officer, Bikramganj, Rohtas vide order dated 06.09.2022. As such, the petitioner ought to file an application before the Circle Officer only and not before this court.

After going through the records and submissions of the parties, it transpires to this court that the original case is Case No. 01 of 2016-17, therefore, the petitioner is directed to file his application along with the order passed by Bihar Land Tribunal in B.L.T. Case No. 38 of 2022 in the said Case No. 01 of 2016-17 before the Circle Officer, Bikramganj, Rohtas so that he shall comply the order passed by Bihar Land Tribunal within 2 months from the date of filing representation.

5. With the aforesaid direction, the present writ application stands disposed of.
