The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.
Diary in this case was called for earlier which has since been received.
Learned counsel for the petitioners submits that though there is allegation against these petitioners in the First Information Report itself, save and except, suspicion there is no material to connect the death of the son of the present petitioners. It is further submitted that there had been enmity between the parties. Learned Additional Public Prosecutor for the State after
Patna High Court Cr.Misc. No.23471 of 2016 (3) dt.05-08-2016 P2/2 perusal of the case diary submits that apart from the allegations made by the informant, there is no other corroborating evidence in the case diary so as to assign the allegation as against these petitioners.
Considering the aforementioned facts and circumstances and there being no further cogent material to implicate these petitioners, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sherghati at Gaya in connection with Barachatti P.S. Case No. 362 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
