The petitioner seeks bail in a case registered under Sections 364/34 of the Indian Penal Code. Later on, Sections 302, 201 of I.P.C. was added.

Allegation is that the accused persons kidnapped the husband of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.11.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired in this case merely on the basis of suspicion. Except for this, there is no other substantial evidence to suggest his implication

Patna High Court CR. MISC. No.15469 of 2020(2) dt.03-03-2020 2/2 in this case. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 2nd, Patna City in connection with Chowk P.S. case No.376 of 2019.
