JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioners are apprehending their arrest in connection with Complaint Case No. 1076C of 2013 for the offences instituted under Sections 147, 323, 427, 354, 380 and 504/34 of the IPC.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that all the accused persons came at the door of the complainant, abused and assaulted her with fists when her daughter-in-law came to save her accused Mukesh is alleged to have pulled down her Sari. It is further alleged that the daughter-in-law of the complainant fled away in

Patna High Court Cr.Misc. No.29262 of 2015 (2) dt.29-07-2015 2/2 her house then all the accused persons entered into her house and broken the house hold articles and abused her in filthy language. Accused Raj Ballabh Rai snatched the silver chain, took out Rs. 10,000/- and attaché containing clothes. Accused Rahul Bihari, Mithilesh and Akhilesh took out the utensils worth Rs. 5,000/-. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is a case and counter case. Counter Case is Naubatpur P.S.Case No. 309/2013. It is further submitted that no offence under SC/ST Act is attracted in the present case.

On behalf of the State it has been submitted that the petitioners are named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1076(C ) of 2013 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Danapur, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
