JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,341,329 and 307 of the Indian Penal Code. The prosecution case is that on protest being made for making construction on the land of the informant the accused persons assaulted the sister in law and niece of the informant. It is submitted by learned counsel for the petitioners that the injury caused by the petitioners is on non vital part of the body.
Considering the fact that the case was instituted in
Patna High Court Cr.Misc. No.26924 of 2015 (2) dt.03-07-2015 2/2 2007, let the learned court below consider the prayer for regular bail of the petitioners in case the petitioners surrender within six weeks from today in connection with Banka (Barahat) P.S. Case No. 285 of 2007 pending in the court of learned C.J.M., Banka. This application is disposed of with the aforesaid observation/direction.
