ANJANA MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 23.06.2017 in connection with a case registered for the offences punishable under Sections 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that he was earlier arrested in connection with another case of motorcycle theft, but in the said case he has already been granted bail. However, in the present case, the petitioner was not involved and no recovery was made from his possession. The recovery of the motorcycle alleged to have been stolen in this First Information Report, was recovered from one Sagar Kumar and not this petitioner. So far as the recovery from the petitioner is concerned, he has already been granted bail in connection with the said case.
Considering the aforementioned facts and circumstances,
Patna High Court Cr.Misc. No.51818 of 2017 (2) dt.09-11-2017 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Laheri P.S. Case No. 342 of 2016.
