JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 412/34 of the IPC.

It would appear from perusal of the written report that some miscreants snatched Rs. 35 lakhs from the employee of Toll Plaza and while they were feeling, they were chased and subsequently, two miscreants were caught by the villagers but the villagers looted the above stated amount from the miscreants and fled away from there. The police, having got the aforesaid information, came and on search recovered huge amount from the house of different villagers. So far as petitioner is concerned, it is said that Rs.

Patna High Court Cr.Misc. No.43556 of 2018 (2) dt.20-07-2018 50,000/- was recovered from his house.

Submission on behalf of the petitioner is that, as a matter of fact, villagers themselves handed over scattered notes to the police but the police, in order to save his skin, lodged false case against the petitioner and several other persons.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioner is in jail custody since 27.5.2018 without having any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Sherghati at Gaya in Amas P.S. Case no. 125/2018.
