Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

No recovery of liquor is alleged from the possession or house of the petitioner rather the co-accused, from whose possession liquor was recovered, named the petitioner as his criminal associate. Petitioner has got no criminal antecedent. Since there is no direct material against the petitioner's involvement, let the petitioner, above named, in the event of his arrest or surrender before the court below within a

Patna High Court CR. MISC.
