JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 408 and 420 of the Indian Penal Code.
It is alleged that the petitioner being employee of Krish Hyundai dealer misappropriated money by not depositing the sale proceeds of the old car in the account of the dealer. It is submitted by the learned counsel for the petitioner that maliciously the accusation has been levelled and it is simply a case of accounting. The petitioner has been roped in the present case because there was some dispute between the petitioner and the proprietor of the dealership with regard to the wages. Statement has been made in paragraph 3 of the petition that the
Patna High Court Cr.Misc. No.27754 of 2015 (2) dt.23-07-2015 2/2 petitioner has no criminal antecedent.
Considering the nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Patna in connection with Kankarbagh P.S. Case No.387 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
