The petitioner seeks bail in a case registered under Sections 399, 402 & 414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.

Allegedly, one live cartridge and two mobiles are recovered in this case.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 09-12-2019. Charge sheet has already been submitted. The petitioner's name has transpired in this case on the basis of disclosure made by the coaccused. one live cartridge and two mobiles are alleged to have

Patna High Court CR. MISC. No.15443 of 2020(2) dt.03-03-2020 2/2 been recovered. Neither any arms nor any stolen property is recovered from the petitioner. There is no compliance of Section 100 Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Pupri P.S. Case No. 332 of 2019.
