The petitioners, seven in number, apprehend their arrest in a case under Section 323 and other sections of the Indian Penal Code and Section 3(I)(X) of the SC/ST (Prevention of Atrocities) Act.
The informant named the petitioners and other accused persons and alleged that they assaulted and abused him by naming his caste. It is submitted that there is a counter-version. The informant came after taking wine and abused and assaulted Pradip Singh and his family members.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.29048 of 2015 (2) dt.24-07-2015 2/2 allegation made against the petitioner, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in Belhar P.S. Case No. 185/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
