Petitioner seeks bail in connection Teghra P.S. Case no. 362 of 2020 registered for the offence punishable under section 414 of the Indian Penal Code read with sections 25(I-B)A, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is in custody since 28.11.2020 and charge sheet has been submitted and from perusal of the allegation as alleged in the FIR, it would manifest that from this petitioner, one mobile and one cartridge are alleged to have been recovered. Learned counsel for the petitioner further submits that petitioner has been falsely implicated in this case and submits that without gun, cartridge is useless.

Patna High Court CR. MISC. No.27921 of 2021(2) dt.22-11-2021 2/2 Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 28.11.2020, charge sheet has been submitted and one mobile and one cartridge have been recovered, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Teghra P.S.
