ANJANA MISHRA ORAL ORDER 30-07-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Learned counsel for the informant is also present.

The petitioners have been in custody since 09.04.2018 in connection with Hathua P.S. Case No. 15 of 2018 registered for the offences punishable under Sections 147/148/ 149/323/324/ 325/371/504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that there is case and counter case between the parties and the injuries have been found to be inflicted on both the sides. It is further submitted that so far as these three petitioners are concerned, save and except the Punit Singh, who was having one antecedent in the past, the other two petitioners are not having any criminal antecedent. It is next submitted that these petitioners shall abide by the terms and

In view of the aforementioned facts and circumstances and that and petitioners are close agnates and there has been a land dispute for which a suit is pending which has led to this occurrence, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-14, Gopalganj, in connection with Hathua P.S. Case No. 15 of 2018, subject to the following conditions:-

(1) One of the bailors will be their own blood relative, preferably, father, mother, brother, sister and/or their wife.

(2) The petitioners shall not indulge themselves in any similar offence till conclusion of the trial.

(3) The petitioners shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, their bail bonds shall be liable to be cancelled by the learned court concerned.

(4) The petitioners shall co-operate with the investigation, if not already concluded, and make themselves available as and when so required and in case of failure,
