JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 324, 307, 34 of the Indian Penal Code and later on Section 302 I.P.C was added. As per prosecution case, information was received about group of persons having beaten up a thief who was caught. On reaching the place of occurrence, the injured thief who was in an unconscious
Patna High Court CR. MISC. No.17379 of 2023(2) dt.16-05-2023 2/3 state was taken to the hospital for treatment who subsequently died. It is alleged that petitioner and other accused persons were involved in beating up of the thief. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Other similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 15.04.2022 passed in Cr. Misc. No. 64310 of 2021. The petitioner is languishing in custody since 25.01.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi in connection with Sahiyara P.S. Case
