JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with G.R. Case No.3873 of 2019, arising out of Sugauli P.S. Case No.204 of 2019, registered under Section 379 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. as on the basis of the fardbeyan of the informant Vijay Prasad, the present case bearing Sugauli P.S. Case No.204 of 2019 was instituted against unknown under Section 379 of the Indian Penal Code on 05.06.2019 regarding the theft of his motorcycle. In course of investigation, co-accused Hari Om Kumar was apprehended by the police and his confessional statement was recorded showing

Further submission is that, in fact, the petitioner is accused in four other cases, as detailed in paragraph-3 to this application, in which he is on bail, due to that reason, the police implicated the petitioner in the present case also showing the confessional statement of the co-accused Hari Om Kumar. In the present case, the petitioner is in custody since 21.09.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with G.R. Case No.3873 of 2019, arising out of Sugauli P.S. Case No.204 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner.
