JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Again, I am not inclined to release the petitioner on bail on the ground mentioned by me in my previous order dated 10.1.2017 passed in Cr. Misc. no 30173/2016 and accordingly, his prayer for bail in connection with Session trial no. 304 of 2017 arising out of Phulparas P.S. Case no. 145/2014 stands rejected.

However, learned trial court must expedite the trial of the petitioner as directed by the Hon'ble Apex Court vide order dated 9.5.2017 passed in Special Leave to Appeal no. 8520/2017.

A copy of this order be sent to the Superintendent

Patna High Court Cr.Misc. No.42339 of 2018 (2) dt.18-07-2018 of Police, Madhubani with direction to him to ensure the presence of prosecution witnesses before the court of Addl. Sessions Judge VII, Madhubani in Session trial no. 304 of 2017 within a reasonable time.
