Petitioner seeks regular bail in connection with Vaishali PS Case No. 370/2021 registered for the offence punishable under Section 30(a) 41(i) of Bihar Prohibition & Excise Act, 2016.
The police on the basis of information that one Mithu Singh and Bodhi Paswan (petitioner) have brought consignment of foreign liquor and are selling near canal situated at Rahimpur road, proceeded to the place of occurrence and upon seeing the police party, the accused persons 5-7 in number succeeded in fleeing away leaving behind their vehicles. The police thereafter, recovered 164.16 litres of illicit liquor from Alto Car bearing Registration No. BRO1AW-1156, 216 litres from Tata Sumo bearing Registration No. BR1P-9263 and 8.640 litres from a motorcycle bearing Registration No. BR31M 0164. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of
Patna High Court CR. MISC. No.18093 of 2022(2) dt.26-05-2022 2/2 information received by the police. He next submits that neither the seized liquor nor any of the vehicles belongs to the petitioner. No illicit liquor has been recovered from the conscious possession of the petitioner and he is in custody since 15.01.2022 having no criminal antecedent.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that no illicit liquor has been recovered from the conscious possession of the petitioner nor any of the vehicles belongs to the petitioner, he is in custody since 15.01.2022 having no criminal antecedent and there is no likelihood that the trial will be concluded in near future, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court No-II, Vaishali at Hajipur in connection with Vaishali PS Case No. 370/2021.
