Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.
According to prosecution case itself, nothing was recovered from conscious possession of the petitioner and the informant claims that petitioner had thrown his firearm prior to his arrest.
Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner is in jail custody since 08.05.2018, let the petitioner be released on bail on
Patna High Court Cr.Misc. No.43417 of 2018 (2) dt.19-07-2018 2/2 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-13, Motihari in connection with Chakia P.S. Case No. 87 of 2018.
