====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Kargahar P.S. Case No. 210 of 2018, instituted for the offence under Section(s) 30(a) and 35 of Bihar Prohibition and Excise Act. Counsel for the petitioner submits that petitioner has voluntarily surrendered in the court below on 15.02.2019 and since then he is in custody. He further submits that petitioner has clean antecedent. He has not been apprehended on the spot. It is alleged in the written report that 171 litres of foreign liquor has been recovered from Scorpio vehicle. Petitioner has been made accused because he is owner of the aforesaid Scorpio vehicle.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.17510 of 2019(2) dt.27-03-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-cum-Special Judge, Excise, Rohtas, Sasaram, in connection with Kargahar P.S. Case No. 210 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
