2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 467, 468, 471, 420, 120(B) and 34 of the Indian Penal Code.
3. As per the prosecution case, petitioner no.1 knowingly omitted names of his other brothers and got the ancestral land mutated in his name. Petitioner no.2 is wife of petitioner no.1.
4. It is submitted on behalf of the petitioners that as a matter of fact petitioners were unaware of the fact that how names of his two brothers were excluded from the purchaser's
Patna High Court CR. MISC. No.21366 of 2024(2) dt.04-04-2024 2/2 column, despite providing a photocopy of the original sale deed dated 11.01.1991 to the cyber cafe for submitting the mutation application. Moreover, matter is purely of civil nature.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Darbhanga in Kamtaul Police Station Case No. 286 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
