The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and 23 of The Petroleum Act, 1934.
It is alleged that 200 liters of diesel were recovered from a Bolero vehicle and on chase one Ranjan Kumar was apprehended, who disclosed the name of the petitioner.
It is submitted by the learned counsel for the petitioner that even assuming the accusation no offence is made out. Moreover, the name of the petitioner sprang up on the confessional statement of co-accused. Statement has been made in para-3 of the petition that petitioner has no criminal

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mahesh Khut P.S. Case No. 54 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
