The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 120(B), 34 of the Indian Penal Code.

As per prosecution case, it is alleged that on 9.6.2021 the son of informant went with the petitioner and other coaccused but he did not return. Thereafter, the dead body of the informant's son was recovered. The informant raised strong suspicion that the petitioner along with others committed murder of her son. Accordingly, the present FIR has been lodged.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There was

The informant is not eye witness of the alleged occurrence rather she raised suspicion against the petitioner. During course of investigation, no any consistent material has come against the petitioner. He has got no criminal antecedent as stated in para-3 of the petitioner. Moreover, he is languishing in judicial custody since 7.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Motipur P.S. Case No. 188 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2nd (West), Muzaffarpur.
