The petitioner is apprehending his arrest in connection with Sheikhpura (Sirari O.P.) P.S. Case No. 120 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 324, 326, 307, 379, 504, 506 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that the informant Shailendra Yadav was returning to his house and Sharun Yadav and Karanjit Yadav were also on the tractor. As soon as the informant reached Old Hospital, Chhilka, to South then accused petitioners Guddu Singh, Naga Singh, Naveen Singh, Sipin Singh, Shiv Shankar Singh came with full of weapons and the accused persons surrounded the tractor of the informant. Patna High Court Cr.Misc. No.27098 of 2015 (3) dt.09-09-2015 2/3 protested by the informant, accused petitioner Shiv Shankar threatened for killing the informant by the order of shooting. It is alleged that Guddu Singh fired his country made pistol with intention to kill the informant and the informant sustained injury in his right leg and accused/petitioner Guddu Singh again fired but fortunately the informant was saved. When the persons on tractor raised protest, accused petitioners began to abuse them and they were threatened by the accused petitioners to shoot them. On alarm accused petitions fled away.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that there is no allegation of any overt act alleged against the petitioner. Other co-accused persons have been granted bail by this Court vide Cr. Misc. No. 29301 of 2015.
On behalf of the State it has been submitted that there is no allegation of overt act alleged against the petitioner. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Sheikhpura ( Sirari O.P.) P.S. Case No. 120 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each
