The petitioner apprehends his arrest in connection with Tekari P.S. (Mou OP) Case No. 57 of 2023 registered under Section 30(A)/41(i)/45 of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that from perusal of Seizure List, it is apparent that the alleged recovery has been made from the hut. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the
