The petitioners apprehend their arrest in Lalganj P.S. Case No. 93/2013, registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code. The informant filed a complaint case alleging therein that petitioner no. 1 and his father persuaded him to send his son with Raj Kumar Paswan (petitioner no. 1) for his livelihood. Akhilesh Kumar, son of the informant went along with Raj Kumar Paswan but Akhilesh Ram did not return.

Learned counsel for the petitioner submits that there is no evidence to show that Akhilesh Ram died or he was taken by the petitioner.

No.31270 of 2015 (3) dt.13-10-2015 2/2 But Learned counsel for the informant as well as learned Additional P.P. have stated that the witnesses have also stated that it was the petitioner who took Akhilesh Ram with him for working. Akhilesh Ram is still traceless. Considering the facts aforesaid and the fact that Akhilesh Ram is still traceless, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
