The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30 (a) and 37(b) of the Bihar Prohibition and Excise Amendment Act, 2018.

It is a case of recovery of illicit liquor from the two motorcycles.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that no incriminating article has been recovered from the conscious or constructive possession of the petitioner and he has not been apprehended at the spot. Petitioner has clean antecedent.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.I, Bhojpur, Ara in connection with Azimabad P.S. Case No. 72 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
