1. Heard learned counsel for the petitioner, learned APP for the State along with learned counsel for the O.P. No.2, Mr. Kaushal Kumar.
2. The learned counsel for the O.P. No.2 at the outset submits that he has instruction on behalf of the O.P. No.2 not to oppose the quashing application and the O.P. No.2 shall have no objection in the event if the quashing application is allowed and the order impugned is quashed.
3. It is next submitted that the dispute was purely matrimonial and the parties have obtained divorce by mutual consent and the O.P. No.2 has already performed her marriage with Avinash Kumar Chaudhary in the year 2019.
4. The learned counsel for the petitioner also concurs
Patna High Court CR. MISC. No.10927 of 2021(4) dt.30-01-2024 2/2 with the submission of the learned counsel for the O.P. No.2.
5. Considering the submission made by the learned counsel appearing on behalf of the O.P. No.2 the entire proceedings arising from Bhagwan Bazar P.S. Case No.444 of 2018 registered under Section 199, 498A, 494, 406, 323, 384, 467, 468, 471 and 420 of the IPC read with Section 3⁄4 of the Dowry Prohibition Act is hereby quashed.
6. The investigating officer of the case in compliance of the order dated 20.06.2023 is present in the Court. The personal appearance of the investigating officer of the case is dispensed with.
