The petitioners seek bail in anticipation of their arrest in connection with Bihriganj P.S. Case No. 41 of 2018 dated 06.03.2018 instituted for the offences under Sections 323, 341, 324, 354(B), 504, 506 and 34 of the Indian Penal Code.
From the perusal of the impugned order, it appears that the petitioners were directed to surrender before the court below and seek bail, which would be decided on its own merits, without being prejudiced by the fact that the Sessions Court has rejected the anticipatory bail of the petitioners.
Regard being had to the nature of accusation
Patna High Court Cr.Misc. No.42154 of 2018(2) dt.20-07-2018 2/2 and the circumstances in which the case was lodged, this Court directs the petitioners to surrender before the court below and seek bail. Once such a petition is filed, the same shall be disposed off by the court below without being influenced by the fact that the present petition has not been allowed.
This petition is dismissed but with the aforesaid liberty.
