JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 06-05-2016 The writ application primarily has been filed for a direction upon the respondent BSRTC to make payment of certain left over amounts under heads, which were disallowed under the package programme, which was approved by Hon'ble Apex Court as part of the Rehabilitation Scheme.

It is not that this claim of the petitioner under heads, which have been disallowed, is not part of the entitlement of the petitioner. The non- payment or settlement of these dues only mean that they have been deferred and it does not mean that it is not payable

The Court observes that the claim of the petitioner under these heads do subsists and if there are further developments by way of further direction by the Hon'ble Apex Court or the better days returns the claim, which were disallowed being not part of the package programme, shall also accrue to the petitioner. Writ application stands disposed of with the above observation.
