ANJANA MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody on his remand in connection with Barun P.S. Case No.215 of 2014 since 25.08.2017 registered for the offence under Sections 302, 201, 147, 148, 149 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner was earlier taken into custody in connection with Barun P.S. Case No.213 of 2014 and Barun P.S. Case No.214 of 2014 under Section 392 of the I.P.C. and Section 25(1-b)a, 26 of the Arms Act, respectively. It is submitted that soon after the petitioner was directed to be released on bail in connection

Patna High Court Cr.Misc. No.51936 of 2017 (2) dt.09-11-2017 2/3 with the above-mentioned two cases, he has been remanded in connection with the present case on the basis of the confessional statement made before the police by one Rahul Kumar, which has no evidentiary value.

In view of the aforementioned facts and circumstances and that the petitioner was not named in the present case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No.215 of 2014, subject to the following conditions:

(1) One of the bailors will be his own relative, namely, father, mother, brother, sister and/or his wife.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.

(4) The petitioner shall co-operate with the
