The petitioner seeks bail in connection with Chenari P.S. Case No. 184/2017, registered for the offences punishable under Sections 21, 22, 23 of the N.D.P.S. Act.

Fifty packets containing 162 gms of Ganja is said to have been recovered from the Betel Gumti of the petitioner. It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. The said Ganja of 162 gms which is said to have been recovered from the said Gumti is of small quantity. Petitioner has been languishing in custody since 20.08.2017.

Considering the facts and circumstances of the case, the

Patna High Court Cr.Misc. No.53877 of 2017 (2) dt.09-11-2017 2/2 petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Rohtas at Sasaram in connection with Chenari P.S. Case No. 184/2017.
