This application, for grant of regular bail, arises out of Paroo P.S. Case No.133 of 2020, registered for the offences punishable under Sections 414/34 of the I.P.C. and Sections 30, 30(a)(c)(d), 33 and 36 of the Bihar Prohibition and Excise Act, 2016.
The learned counsel for the petitioner submits that petitioner is in Custody since 22.01.2021 and charge-sheet has been submitted. Learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the FIR, it would be manifest that 660 litres of Raw spirit for preparing liquor and 10.500 litres of Royal Stag foreign liquor was recovered from the brick kiln with which the petitioner has
Patna High Court CR. MISC. No.27679 of 2021(3) dt.22-11-2021 2/2 no concern. The learned counsel for the petitioner further submits that after this case was instituted, the petitioner came to be implicated in eight more cases of liquor.
Learned APP vehemently opposed the prayer for bail. Considering the fact that charge-sheet has been submitted against the petitioner and he is in custody since 22.01.2021, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Paroo P.S.
