For the Petitioner/s : Mr. Mukesh Kumar Jha For the Opposite Party/s : Mr. Sanjay Kumar Pandey(App) ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioner apprehends arrest in Complaint Case No 1236 of 2000 instituted under Sections 366, 366A, 120B of Indian Penal Code lodged by the father of the victim girl who is said to have been kidnapped.
Learned counsel for the petitioner draws attention of the Court to the statement made under Section 164 of Criminal Procedure Code (Cr P C) by the victim girl where she has categorically stated that petitioner is married and has three children and did not even touch her at any point of time. Learned counsel further points out that as per the complaint itself, the girl went missing on 01.07.2000 and allegedly was recovered at Malda
Patna High Court Cr.Misc. No.18232 of 2015 (2) dt.11-06-2015 in West Bengal on 07.07.2000 but the complaint was filed on 10.07.2000 for which there is no explanation. Further, he submits that the statement of the girl was then recorded under Section 164 of Cr P C on 17.11.2000. He had been implicated only because he is a neighbour and had some dispute with the father of the girl. Be that as it may, in the event of his arrest or surrender within four weeks from today, the petitioner abovenamed shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 01st Class, Katihar in Complaint case No 1236 of 2000 subject to all conditions as laid down in Section 438 (2) of Cr P C.
