Mr. Syed Mojibur Rahman, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-04-2025 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 316, 504, 506 and 34 of the Indian Penal Code.
3. As per prosecution case, on the alleged date and time of occurrence, it is alleged that all the accused persons named in the F.I.R., including these petitioners, assaulted minor daughter of informant with fist and slap and on objection, all the
Patna High Court CR. MISC. No.16901 of 2025(2) dt.16-04-2025 2/3 accused persons assaulted informant by means of lathi and caused miscarriage.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, Petitioner Nos. 1 and 2 are sisters-in-law (Nanads), Petitioner No. 3 is father-inlaw, Petitioner No. 4 is mother-in-law and Petitioner No. 5 is brother-in-law (Dewar) of the informant and due to petty family feud, this false and concocted case has been lodged. Allegations of assault is general and omnibus and there is no specific accusation of overt act against these petitioners. It is further submitted that doctor has found no external injuries on the body of informant which itself falsifies the entire prosecution case.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the general and omnibus nature of accusation and medical report, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs.
Patna High Court CR. MISC. No.16901 of 2025(2) dt.16-04-2025 3/3 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Sripur P.S. Case No. 90 of 2024, subject to condition as laid down under Section 482(2) of the B.N.S.S..
