JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 323, 504, 409 and 420 of the Indian Penal Code and Sections 3 (i) (x) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Learned counsel for the petitioner submits that the complaint was instituted after 33 years of the alleged occurrence. The informant alleged that in 1979 he was posted at Purnea District in Irrigation Department. The complainant alleged that the petitioner, who is an agent in Land Development Bank, took his signature on the application to get the loan, which the informant later on learnt that this petitioner has misappropriated the loan amount.
As the case has been lodged after 33 years of the
Patna High Court Cr. Misc. No.35725 of 2014 (2) dt.04-03-2015 2 / 2 occurrence, in that view of the matter, in the event of arrest or surrender before the court below within four weeks from today the above named petitioner be released on anticipatory bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Sarairanjan P.S. Case no. 165 of 2013 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
