The petitioner is in custody since 16.04.2018 in connection with Kajraili P.S. Case No. 33 of 2018 for the offence registered under Sections 394 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the first information report is against unknown persons, later on, in the further statement made by the informant, the name of coaccused persons, namely, Ashok, Jitendra and Dharmendra Kumar (present petitioner) surfaced. Thereafter, one Jitendra Kumar Yadav was arrested and on his confessional statement made before the police, the petitioner has been taken into custody, which has no evidentiary value. It is further submitted that nothing has been recovered from the possession of the petitioner and the petitioner is a poor agriculturist and merely works on daily wages

Patna High Court Cr.Misc. No.42545 of 2018 (2) dt.19-07-2018 for his livelihood. The petitioner has got no criminal antecedent. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-XIV, Bhagalpur in connection with Kajraili P.S.
