====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in connection Barachatti P.S. Case no. 24 of 2021 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Amendment Act. Learned counsel for the petitioner submits that the petitioner is in custody since 11.01.2021 and is person with clean antecedent and charge sheet has been submitted. Further from allegation as alleged in the FIR, it would manifest that 1575 liter liquor has been recovered from a vehicle which does not belong to the petitioner.

Learned APP opposed the prayer for bail.

Considering the facts that petitioner is in jail custody since 11.01.2021 and is person with clean antecedent and charge

Patna High Court CR. MISC. No.27927 of 2021(2) dt.22-11-2021 2/2 sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge, Excise Act, Gaya in Barachatti P.S. Case no. 24 of 2021.
