JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Terhagachh P.S. Case No. 41 of 2017 dated 25.5.2017 for the offences punishable under Sections 379 of the Indian Penal Code. The case of the prosecution in brief is that when the informant along with his wife went to his father-in-law's house by his motorcycle and after supper at night they went to their bed and when they woke up, they found that their motorcycle had been stolen. Subsequently, while the petitioner was showing the papers of motorcycle at a wielding shop, the wielding shop owner suspected foul play and informed the police, whereupon the petitioner was apprehended and upon his confession, three other accused persons were apprehended from whom it appears that they

Patna High Court Cr.Misc. No.50026 of 2017 (2) dt.17-10-2017 2/2 were dealing in the business of sale and purchase of stolen motorcycle.

The learned counsel for the petitioner submits that the petitioner has a clean antecedent and in fact, he was allured by the accused persons for being given commission if he would help them in selling the motorcycle. However, the petitioner does not know the accused persons who are engaged in selling the stolen motorcycles. The learned counsel for the petitioner further submits that the petitioner is languishing in jail since 20.07.2017. In the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Kishanganj in connection with Terhagachh P.S. Case No. 41 of 2017.
