Having regard to the fact that the petitioner faces prosecution for the offences punishable under Section-47A of the Excise Act and that he has a dubious past in the sense that even on earlier occasion he was facing the similar allegation in Akbarpur P.S. Case no. 52 of 2011, this Court is not inclined to grant anticipatory bail to the petitioner.
The prayer for anticipatory bail of the petitioner is accordingly rejected.
It however goes without saying that if the petitioner surrenders within a period of four weeks from today, his prayer for regular bail shall be considered without being prejudiced by anything said in this order.
