The petitioner seeks bail in connection with N.D.P.S. Case No. 07 of 2017, arising out of Chapra Rail P.S. Case No. 30 of 2017 dated 02.05.2017 instituted for the offences under Sections 8/20(b)(ii)(c)/22 of the Narcotic Drugs & Psychotropic Substances Act, 1985.

From the F.I.R, it appears that from the possession of the petitioner, a trolley bag was recovered which contained ten kgs of Ganja.

Learned counsel appearing for the petitioner has submitted that the bag does not belong to him and the petitioner has wrongly been implicated in this case. It has further been submitted that petitioner is a contractor with Mahajan Real Estate

Patna High Court Cr.Misc. No.36727 of 2017 (4) dt.03-01-2018 2/2 Private Limited, Vivek Vihar, New Delhi and on the day when he was allegedly caught with the narcotic, he was going to his working place. The petitioner has clean antecedent and is in custody since 03.05.2017.

Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran in connection with N.D.P.S. Case No. 07 of 2017, arising out of Chapra Rail P.S. Case No. 30 of 2017.
