This application for anticipatory bail, arises out of Sursand Police Station Case No. 71 of 2016, disclosing offences punishable under Sections 147, 148, 149, 341, 323, 324, 379, 308 and 504 of the Indian Penal Code.
There is allegation against the petitioner that he assaulted the informant with sharp-edged weapon on his head and snatched from him an amount of Rs. 3500/-. It is evident from the First Information Report that the occurrence, if any, had taken place because of some land dispute and attempts were being made to get the dispute resolved, in course of which, the occurrence had taken place.
Patna High Court CR. MISC. No.21423 of 2019(2) dt.05-04-2019 2/2 Learned counsel for the petitioner has submitted that for the same occurrence, a counter case has been filed by the coaccused Shivji, which has been registered as Sursand Police Station Case No. 74 of the 2016.
Considering the nature of accusation, this application is allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Sursand Police Station Case No. 71 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
