The petitioners seek bail in a case registered for offence under sections 147, 148, 149, 353, 307, 332, 333, 186, 187, 115, 153B, 295A, 341, 120B and 325 of the IPC.
Counsel for the petitioners submits that the petitioners and a large number of persons have been alleged to have disturbed the communal harmony and threw bricks on the police party when it tried to control the mob, but there is no specific allegation against them and similarly situated co-accused Sumit Kumar as well as Vijay Kumar Yadav, Pawan Kumar Yadav and Ram Chandra Yadav have already been enlarged on bail by this Court vide orders dated 23.11.2017 and 12.12.2017, passed in Cr.Misc.No. 56115 of 2017 and 57512 of 2017. Petitioners are in custody since 3.10.2017 having no antecedent.
In the facts of the case, prayer for bail of the petitioners is allowed. Let all the three petitioners, as mentioned above, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to
Patna High Court Cr.Misc. No.60257 of 2017 (2) dt.20-12-2017 the satisfaction of the Addl Chief Judicial Magistrate 1st, Hilsa (Nalanda) in Hilsa Police Station Case No. 638 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with they. The bailor will also undertake to inform the court if there is any change in the address of the petitioners. (b) The petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
