The allegation against the petitioner, who happened to be the Panchayat Secretary of Harpur Jalwasy Panchayat, is that he defalcated Rs.3,42,400/- which was advanced to him for constructing the drainage in the said Panchayat. The attention of the Court has been drawn to the representation filed by the petitioner, of course, subsequent to the filing of the report in which it was clearly stated that there was dispute in respect of the land through which the drainage was to pass and on that account as also because the land being not available, the scheme could not be implemented and the money was deposited back into the relevant account as back as in March, 2013. In support of the contention the statement of Bank accounts has been placed at page-16 of the present petition.

No.36137 of 2014 (2) dt.20-02-2015 Let the above named petitioner be directed to be admitted to bail, either in the event of his arrest by the police or surrender in the court below in connection with Itarhi P.S.Case No.146 of 2013 to the satisfaction of CJM, Buxar on furnishing bond of Rs.5,000/- with two sureties of the like amount each subject to the condition as laid down under Section 438(2) Cr.P.C.
